Gulfstream Park has voluntarily dismissed a federal lawsuit seeking to block slots installation of Vegas-style slots in casinos operated by Florida Seminole Tribe, saying that since the judge declined to issue an injunction and the tribe already has installed slots, the effort is moot.
Gulfstream now is looking to a lawsuit filed in the Florida Supreme Court last year by the state House of Representatives challenging the constitutional authority of Gov. Charlie Crist to enter into a compact with the Seminoles authorizing the slots and some table games.
There has been no indication when the Florida Supreme Court might issue a ruling.
Marc Dunbar, who represents Gulfstream Park, said Gulfstream's lawsuit was filed as an attempt to block the installation of slots in the Seminole casinos.
“There was no reason to keep the federal case down here,” Dunbar said. “It became moot. It wasn’t appropriate to keep it going until the (state) Supreme Court rules.”
